Can Undocumented People File a Personal Injury Claim?

We sometimes get asked whether undocumented people can file a personal injury claim. Since there is some confusion with this topic, we wanted to briefly answer the question. And if you have any more questions, please feel free to consult our office.

In a personal injury or wrongful death action, a person’s immigration status is irrelevant. This means that whether someone is an undocumented citizen or not, they can file a lawsuit. If someone else injures you, you have a write to file a personal injury lawsuit to recover for your damages. During the lawsuit, your immigration status cannot be raised as any issue whatsoever. Your immigration status does not have to be disclosed during the course of the claim.
