Early Morning Collision on US101 in San Jose Leaves One Trapped

Anderson Franco Law

A traffic collision involving two vehicles occurred early this morning on northbound US101 near Tully Road in San Jose. The incident was reported at approximately 5:08 AM and involved a black Toyota RAV4 and an unknown sedan. Emergency services were promptly dispatched to the scene.

The collision resulted in significant disruption, with lanes 1, 2, and 3 initially blocked. One individual was trapped inside the Toyota RAV4, with both legs injured, and required assistance to be freed. Airbags were deployed in both vehicles, indicating the severity of the impact. Tow trucks were called to clear the vehicles, and all lanes were reopened by 6:09 AM.

Motorists are advised to exercise caution when traveling through the area, as residual delays may persist. Our thoughts are with those affected by this unfortunate incident, and we hope for a swift recovery for the injured.

Potential Legal Considerations

When someone gets hurt because of another person’s carelessness, it’s called negligence. In these situations, the person who got hurt might have the right to get help or money for what happened to them. To prove negligence, the injured person must show that the other person had a duty to be careful, didn’t do their duty, and caused harm because of it. For example, if a driver doesn’t pay attention to the road and causes an accident, they might be considered negligent.

Victims of negligence can often make claims to get money for their troubles. This can include things like medical bills, lost wages from not being able to work, and other costs related to the incident. Sometimes, the person who caused the harm has insurance that can help pay for these costs. For instance, if the accident was a car crash, the driver’s car insurance might cover some of the expenses.

Insurance claims can be a big part of getting help after an injury. The injured person or their family might need to file a claim with the insurance company of the person who was at fault. It’s important to keep records of everything related to the injury, like doctor visits and any other expenses. This information can help when talking to the insurance company to make sure the victim gets the help they need.

In some cases, if the insurance doesn’t cover everything, the injured person might need to go to court to get fair compensation. This can be a long process, but it might be necessary to make sure the victim’s rights are protected. It’s always a good idea for victims to talk to a lawyer who knows about personal injury cases to get advice on what to do next.
