Fatal Crash on SR-85 in San Jose Causes Major Traffic Disruptions

Anderson Franco Law

A tragic accident occurred on the southbound lanes of State Route 85 near the Almaden Expressway offramp in San Jose on the evening of May 4, 2025. The incident, which was reported at approximately 8:06 PM, involved a black SUV that collided with an embankment and overturned, blocking all lanes of traffic. Emergency services were promptly dispatched to the scene, but despite their efforts, one individual was pronounced deceased at 8:30 PM.

The crash resulted in significant traffic disruptions, with all lanes remaining closed for several hours as authorities worked to clear the scene and conduct an investigation. Motorists were advised to avoid the area and seek alternate routes, as vehicles attempting to bypass the congestion were seen exiting at the Camden onramp. The right-hand shoulder was eventually opened to allow some traffic flow, but delays persisted late into the night.

Our thoughts are with the victim’s family and friends during this difficult time. Authorities continue to investigate the cause of the accident. Drivers are reminded to exercise caution and adhere to traffic advisories to ensure their safety and the safety of others on the road.

Potential Legal Considerations

When someone is hurt because another person was careless, it is called negligence. In these cases, the person who got hurt might have the right to get help or money for what happened. To show that someone was negligent, we need to prove four things: duty, breach, causation, and damages. First, the person who caused the harm must have had a duty to be careful. Second, they must have failed to be careful, which is called a breach. Third, this breach must have directly caused the harm. Lastly, there must be actual harm or damages.

Victims of negligence can seek compensation for their injuries. This means they can ask for money to cover things like medical bills, lost wages, and other costs related to the incident. Sometimes, they can also get money for pain and suffering. To do this, they might need to file a lawsuit against the person or company responsible. It’s important for victims to gather evidence, like photos, witness statements, and medical records, to support their case.

Insurance can also play a big role in these situations. Many people have insurance that can help cover the costs of an accident. For example, if the incident involved a car, the driver’s auto insurance might pay for the damages. Victims should contact their own insurance company to report the incident and see what coverage they have. They might also need to deal with the other person’s insurance company. It’s important to be honest and provide all the necessary information to make sure the claim is handled properly.
