Hit-and-Run Incident with Injuries Reported in San Jose

Anderson Franco Law

A hit-and-run incident resulting in injuries occurred on the evening of April 16, 2025, in San Jose. The incident took place at approximately 6:13 PM near the Camden Avenue offramp on southbound State Route 85. Initial reports indicated no injuries, but the situation was later updated to confirm injuries were sustained.

Emergency services were promptly dispatched to the scene, located in a small parking lot adjacent to the offramp. Units were assigned and arrived at the location shortly after the incident was reported. The California Highway Patrol (CHP) is currently investigating the circumstances surrounding the hit-and-run, and efforts are underway to identify and locate the driver responsible.

The community is urged to exercise caution in the area as the investigation continues. Authorities are appealing to anyone with information about the incident to come forward. Our thoughts are with the injured parties, and we hope for their swift recovery.

Potential Legal Considerations

When someone is hurt because of another person’s carelessness, it is called negligence. In legal terms, negligence means that someone did not act as carefully as they should have, and this caused harm to another person. For example, if a driver does not pay attention to the road and causes an accident, they might be considered negligent. The person who got hurt because of this can have the right to seek compensation for their injuries.

Victims of negligence can file a personal injury claim to get compensation for things like medical bills, lost wages, and other costs related to the accident. To succeed in a personal injury claim, the victim must show that the other person was indeed negligent and that this negligence directly caused their injuries. This often involves gathering evidence, such as witness statements, photos of the accident scene, and medical records.

Insurance can play a big role in personal injury cases. Most drivers have car insurance, which can help cover the costs of an accident. If the person who caused the accident has insurance, the victim can file a claim with that insurance company. The insurance company will then investigate the accident and decide how much money to offer the victim. Sometimes, the insurance company might not offer enough money, and the victim might need to negotiate or even go to court to get fair compensation.

In some cases, the person who caused the accident might not have insurance or might not have enough insurance to cover all the costs. When this happens, the victim might be able to use their own insurance policy if they have coverage for uninsured or underinsured motorists. This type of coverage can help fill in the gaps and ensure that the victim gets the compensation they need to recover from the accident.
